Vancouver, WA - Clark County Sheriff’s officials have released bodycam footage showing the events of a deadly stabbing incident involving a deputy and a man in custody under suspicion of driving under the influence.
The incident began on May 7 as a suspected DUI investigation. Clark County Sheriff’s deputies responded around 11 p.m. to a crash near NE 14th Court and Minnehaha Street in Vancouver. At the scene, deputies reportedly discovered that a car had crashed into two parked cars in the area.
The driver, 54-year-old Marc Fogle, was detained by deputies and later taken to a state patrol weigh station in Ridgefield, because that station was equipped with a breath alcohol analyzer.

Once at the weigh station, Deputy Bryson Layton removed Fogle’s handcuffs to administer the breath analyzer test. After removing the cuffs, Fogle puts his hands on his head and tells Layton he’s doing that “for your safety.” Layton responds,” You promise you’re not gonna hurt me?” To which Fogle replies, “I’m promising.”
After another brief exchange over keeping his hands on his head, Fogle says to Layton, “You don’t know who you’re dealing with.” Layton again asks Fogle if he is going to hurt him, and Fogle again says he is not.
Layton and Fogle talk about whether or not he wants to call a lawyer.
Fogle remarks, “Maybe I’ll make it through the night.” Layton tries to reassure him, saying that he is making the situation into something bigger than it is.
Layton then checks Fogle’s mouth for any objects. Fogle then says that “his life is over” because he says he’s a CDL driver, and now he won’t be able to make a living. The conversation continues to shift in intensity, with Fogle repeating that his life his over, saying that he is a dead man, and eventually saying that “it’s only you and me in this room.” Layton asks Fogle if he is trying to threaten him, and then asks Fogle to stand up so he can put him back in handcuffs.
Fogle stands, but does not comply with Layton’s commands to turn around and put his hands behind his back. The fight ensues and Layton is heard shouting, “get the f*** away from me” and “he’s reaching for my gun.” Layton then tells Fogle he is going to shoot him and Fogle replies, “that’s what I want.”
During the fight, investigators said Layton’s bodycam was deactivated. When the camera footage returns, Fogle has already been stabbed several times in the back.
According to a press release of the timeline of events, Layton and Fogle arrived at the weigh station at 11:33 p.m. Roughly 30 minutes later, the deputy reported over the radio that he was fighting with the DUI suspect. Paramedics were called after the fight, but Fogle was pronounced dead at the weigh station just after 12:30 a.m.
Layton was not injured
