As Solomon walks past Petersen toward Laura Street, Petersen pulls a handgun from his waistband and a confrontation ensues. Then Solomon pulls a handgun from under his shirt and both open fire. Seconds later, Petersen crumples to the ground as Solomon flees.
Arrested two days later, Solomon acknowledged being armed at the Landing and shooting Petersen, but maintained he did so only in self-defense, according to the State Attorney’s Office review of the incident.
The 13-year-old, meanwhile, was hit in the ankle by stray gunfire from Solomon’s gun.
Prosecutors ruled Solomon, who felt threatened by Petersen’s words and actions, had no obligation to retreat from the confrontation. He escaped without injury.
“Petersen’s actions created a reasonable belief in Tyrik Solomon that deadly force was necessary to prevent imminent death of great bodily harm to himself,” according to the State Attorney’s Office report.
“The State agrees with the Jacksonville Sheriff’s Office that there is no evidence to disprove [Solomon’s] statements that he shot [Petersen] in self-defense. In fact the physical evidence recovered at the scene coupled with the video surveillance corroborates Solomon’s claim of self-defense,” the report concluded.
