Florida Dad Held at Gunpoint in His Own Driveway By Cop Over a Traffic Stop He Never Saw, Tesla Cameras Clear Him After Two Years

WINTER SPRINGS, Fla. — A father who had just dropped his kids off at school ended up staring down guns in his own driveway, slapped with a felony, and forced to live under that charge for nearly two years. Then his Tesla cameras did what the system would not: they proved he never fled anyone.

Kevin Finley said he was driving home when he passed a vehicle sitting in a median. He figured it was broken down or about to make a U-turn. It was an unmarked Winter Springs police car. An officer went after him. Finley said he never saw emergency lights and never heard a siren.

The Tesla footage told the same story. The patrol car’s lights were visible for only a brief moment. Curves in the road and buildings then blocked the unmarked vehicle from view. Finley kept driving home the way an ordinary commuter would. He pulled into his garage. Only then did he hear sirens. He opened the door to see what was happening — and found officers pointing guns at him while neighbors watched.

“This is, argumentatively, a simple traffic violation. And now I have a gun in my face and I’m arrested in my driveway,” Finley said.

On the scene, an officer can be heard weighing the options out loud: hit him with the felony side of flee and elude, or stack traffic infractions. They went with the felony, fleeing and eluding plus criminal reckless driving. Those are serious charges. Fleeing police is a felony. Reckless driving carries jail time. Finley spent almost two years with lawyers, a felony hanging over his record, and the question of whether a school drop-off drive would send him to prison.

When the video finally reached the courtroom, the judge did not send the case to a jury. He acquitted Finley on the spot.

Finley has said he is considering a civil lawsuit. Prosecutors could have reviewed the same footage years earlier and dropped the case. They did not. A father who opened his garage door instead of running was treated like a fleeing felon until a car’s cameras forced the court to look at what actually happened on that road.
